In New York, it is illegal for someone to discriminate against you because of your gender identity or expression. This means you're protected from unfair treatment at work, in housing, at school, and in public places like stores and restaurants.

The law protects transgender, non-binary, gender non-conforming people, and anyone whose gender expression doesn't match what others expect.

This means that:

  • Employers cannot ask about your body parts in job interviews
  • Landlords cannot refuse to rent to you
  • Businesses cannot deny you service
  • You can use bathrooms and locker rooms that match your gender identity.

New York's Division of Human Rights website includes a video example about a tenant whose landlord wouldn't use their correct pronouns, which is illegal discrimination. 

If someone treats you badly because of your gender, you can file a complaint with the New York State Division of Human Rights. You have up to three years to file a complaint for recent discrimination.
