If you've experienced police misconduct, like excessive force or false arrest, you can sue the government.

You must file a legal document called a "Notice of Claim" within 90 days from the date it happened. This notice says you plan to take legal action against them. You file it at the the government agency or municipality that supervises the officer/s who harmed you.

If you miss the 90 day deadline, it's harder to sue for the misconduct.

In the Notice of Claim, include important details, such as: 

  • the date and location of the incident,
  • the officers' names,
  • a description of what happened,
  • and the injuries or damages you suffered.

The more details, the better.

Once you submit the Notice of Claim, the government agency or municipality reviews it. They might investigate. This gives them a chance to address the issue and try to resolve the matter before you file a lawsuit. 

If they deny your claim or don't respond within a certain time, you can file the lawsuit. You can ask for compensation (money) for the harm you suffered and the violation of your civil rights.

You can file a Notice of Claim with the New York City Comptroller’s Office.
