If you are not a US citizen and your children live with you, make a plan now in case you are ever detained by ICE or another federal agent.

Depending on your situation, some of these legal forms may help protect your children:

  • Designation of Person in Parental Relationship (PPR): Lets someone take care of your child right away if you are detained
  • Designation of Standby Guardianship (SBG): Lets someone care for your child over the longer term
  • Authorization for Travel: Lets your child travel with a caregiver
  • School Emergency Contact Form: Tells your child's school who to call and who can pick up your child
  • Power of Attorney: Lets someone manage your money or property in the US

Use the "Planning for your kids" checklist to figure out what you need. It has questions on the left side and the matching forms on the right. As you answer each question, you can see which forms apply to your situation. Fill out the checklist separately for each child, since their situations may be different.

After you fill out your forms

Whichever forms you choose, follow the next steps:

  • Sign each form the right way. Some need a notary, others need witnesses. Read the instructions on each form.
  • Give copies to whoever you name as caregiver.
  • Update your child's school with the right emergency contact.
  • Talk to your caregiver about your child's needs, schedule, and your wishes.
